Luxe Cakes Terms and conditions 

 

  1. A non-refundable deposit of 50% is required to secure your date. If you cancel for any reason, this will not be returned to you, however, if I am forced to cancel, you will be given notice and refunded in full. By paying the deposit and securing the date you are accepting the below terms and conditions.

  2. Quotes are valid for 30 days from the date of creation, if you choose to proceed with your booking after this period the price may differ as prices are subject to change. This also applies if you change your date of order, as I am subject to price increases from suppliers etc.

  3. All our products are made in a kitchen where celery, gluten, eggs, fish, nuts, milk, peanuts, sesame seeds, lupin, mustard, soy and sulfites are used and although I offer some free-from products and take every precaution to minimise cross-contamination, this can not be 100% guaranteed, similarly, I cannot guarantee that any product is entirely nut-free although I make every effort to ensure this. 

  4. I do cater for most allergies and have a selection of recipes for gluten free etc, however, if a severe allergy is known it is your responsibility to inform your guest not to eat the cake due to the possibility of trace allergens. All cakes, cupcakes, etc will have an allergen information sheet attached to the main box/ packaging and it will be the responsibility of the customer to inform all consumers of this. 

  5. Luxe Cakes will not be held responsible for any allergic reactions that may occur after someone comes into contact with or after consuming any of my products regardless of the severity of this, including death. In addition to this, It is crucial that any known allergies and intolerances be made known at the earliest point possible as some orders will not be accepted based on this.

  6. The final balance is due no later than 4 weeks before the event date. If you choose to cancel after this has been paid it will not be refunded.

  7. Any amendments to the agreed cake design will be at my discretion and subject to additional fees. The cut off for any changes is 4 weeks before the event, after which they will not be possible.

  8. Depending on your chosen design, cakes may include non-edible decorations. Both you and the venue will be informed in detail of these and it is your responsibility to remove them before the cake is served.

  9. If you have any concerns regarding the cake please notify me before delivery and I will do everything I can to solve the problem. Once the cake is cut and served, this will signify your acceptance that the cake was fit for purpose and no compensation will be given.

  10. All agreed details will be detailed on your invoice, so if you spot any errors or changes you wish to be made, this is the point at which to do so. I will then amend the invoice and send a new one out with the changes, however this may incur extra charges if it involves more labour or materials.

  11. If you add any decorations to the cake after my delivery and setup I cannot be held responsible for any damage to the cake, such as water from the flowers spoiling the icing etc. Flowers provided by your florist should be free from chemicals and pesticides, and if you’re unsure please speak to your florist about which flowers will work best on an edible item.

  12. Once the cake is set up at the venue, I am not responsible if someone else moves it or places it in an unsuitable location. I will of course set up in its final location whenever possible and ensure that everything is exactly as it should be before leaving. If the cake is damaged after I leave it will be the responsibility of the venue.

  13. Some cakes such as fruit or chocolate will need to be cut with care by the caterers as they may crumble. The responsibility of the presentation of cut slices of cake lies with the caterer/venue.

  14. If you are picking the cake up from me I cannot be held responsible for any damage once it leaves my premises. Every cake is professionally assembled and will be absolutely fine if driven carefully on a flat surface.

  15. All cakes are baked and decorated with the intention of being eaten on the event day. After this date, it is at your own risk that you eat any leftovers as I cannot guarantee or control storage conditions which affect shelf life. Fruit cake is the only exception and will keep for several months in a cool dry place (not refrigerated).

  16. Buttercream cakes are not advisable during hot months or in hot venues such as marquees. With outdoor venues such as a marquee, insects and other bugs are likely to enter on hot days, so the choice to have a buttercream cake is at your own risk and I will not be held responsible once set up.

  17. Some venues do not like having naked cakes in hot months, so please check with them before ordering.

 

Complaints

Complaints are very rare due to the amount of work put into each individual cake, cupcakes, etc I take them very seriously. Any issues must be bought to my attention within 24 hours of collection or delivery to give me a fair opportunity to assess the nature of the complaint/s.

Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof, and providing the other party with a prior opportunity to resolve any issues between the parties amicably.

 

Complaints regarding the decoration of celebration cake can be easily repaired so errors of this nature must be pointed out upon delivery/collection so as to give me the opportunity to correct them. Once payment has been handed over (on collection or delivery if applicable) this confirms that decoration is as requested and no further claims can be made.

 

Where the complaint is in regards to the quality of the cake then the cake, or remainder of the cake/tier, must be returned to me as soon as possible after cutting and within 24 hours of collection/delivery to ensure that I am able to fairly assess the nature of the complaint.

Please note that I can only deal with the client who placed the original order.

 

  • Cakes must be brought back within 24 hours of being in your care. Please call us promptly to let us know of the issue.

  • Quality determination is solely at the discretion of Luxe Cakes.

  • Please understand that I cannot issue refunds for cakes that have already been completely eaten.

  • Credit percentage is based on how quickly the cake is returned, how much has been consumed and what we determine the quality to be at my discretion 

  • Credit will not be issued to customers who do not contact us within 24 hours.

  • Please note all refunds will be given as a store credit. No cash/money refunds will be given.

 

General Terms

  1. Prices are regularly reviewed and are at subject to change at any given time without prior notice. 

  2. All designs and intellectual property rights remain the property of Luxe Cakes.

  3. I reserve the right to use images of your cake for any form of advertising including web based promotions, brochures, galleries and competitions and this applies to any pictures sent to me as well. It is advisable that you make a copy of all documentation received from Luxe Cakes for your own benefit.

  4. This Agreement together with Order Confirmation documents provided constitute the entire agreement and understanding between the parties relating to the order. Except as may be expressly stated in this Agreement, it supersedes and cancels all prior agreements, statements, representations, understandings, negotiations and discussions, whether oral or written, between the parties. Each of the parties acknowledges and agrees that in entering into this Agreement it does not rely on any statement, representation, warranty or understanding made prior to this Agreement save to the extent that such statement, representation, warranty or understanding is incorporated into this Agreement. Each of the parties acknowledges and agrees that in entering into this Agreement it has not relied on (or has been induced to enter into this Agreement by) any statement, representation, warranty or understanding made prior to this Agreement. Nothing in this paragraph excludes any liability for fraudulent misrepresentation.

  5. In the event that any one or more such provisions of this Agreement should be deemed to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity and enforceability of the remaining valid and enforceable provisions thereof which shall be construed as if such invalid or unenforceable provisions had not been inserted.

  6. The parties agree to submit to the non-exclusive jurisdiction of the English courts.

  7. Any headings utilised in this Agreement have been inserted for the convenience of reference only and should in no way restrict or otherwise affect the construction of the terms and conditions .
